1. Introduction
- Welcome to Bawn’s Affiliate Program. By participating in our Affiliate Program, you agree to comply with these Terms and Conditions. Please read them carefully before you start using the program.
2. Eligibility
- The Affiliate Program is open to licensed insurance agents and brokers who are 18 years of age or older.
- Bawn reserves the right to verify the eligibility of participants and may refuse entry or disqualify any participant who does not meet the eligibility criteria.
3. Enrollment in the Program
- To enroll in the Affiliate Program, you must complete the registration form on the Bawn website.
- Once your application is approved, you will receive a unique referral code or link to share with your clients.
4. Referral Process
- Affiliates can refer potential clients to Bawn using their unique referral code or link.
- A referral is valid only if the client is not already in contact with Bawn and the client uses the affiliate's referral code or link when signing up.
5. Referral Payouts
- Affiliates will earn a $1,000 finder’s fee for each referral that results in a closed deal.
- A deal is considered closed when the referred client signs a binding agreement with Bawn and completes the initial payment.
- Payments will be processed within 30 days of the deal’s closure via the payment method selected during sign-up.
- Bawn reserves the right to withhold payment if it suspects fraudulent activity or if the referral does not meet the program’s terms.
6. Taxes
- All referral payouts are considered taxable income. Affiliates are responsible for reporting and paying any applicable taxes on their referral earnings.
- Bawn will issue a 1099-MISC form to U.S.-based affiliates who earn $600 or more in a calendar year.
7. Confidentiality
- Affiliates agree to maintain the confidentiality of all proprietary information obtained during their participation in the Affiliate Program, including client information, pricing details, and any other sensitive information related to Bawn’s operations.
8. Compliance with Laws
- Affiliates must comply with all applicable federal, state, and local laws, including advertising and disclosure requirements. This includes clearly disclosing your relationship with Bawn when promoting the Affiliate Program or referring clients.
9. Termination of Participation
- Bawn reserves the right to terminate or modify the Affiliate Program at any time, with or without notice.
- Bawn may also terminate an affiliate’s participation in the program for any reason, including but not limited to fraudulent activity, breach of terms, or misuse of referral codes.
10. Limitation of Liability
- Bawn shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the Affiliate Program, including any failure to process or pay referral fees due to technical errors, loss of data, or other unforeseen circumstances.
- Bawn’s total liability for any claims arising out of or relating to the Affiliate Program shall not exceed the amount paid to the affiliate during the three months preceding the date of the claim.
11. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of laws principles.
12. Amendments
- Bawn reserves the right to update or amend these Terms and Conditions at any time. Affiliates will be notified of any significant changes via email or through the affiliate dashboard.
